Order Suspending Attorney from the Practice of Law

Case Name: BOARD OF PROFESSIONAL RESPONSIBILITY, WYOMING STATE BAR v. SCOTT M. POWERS, WSB No. 6 3188

This matter came before the Court upon a “Report and Recommendation for Suspension,” filed herein April 11, 2014 by the Board of Professional Responsibility for the Wyoming State Bar, pursuant to Section 16 of the Disciplinary Code for the Wyoming State Bar (stipulated discipline). The Court, after a careful review of the Board of Professional Responsibility’s Report and Recommendation and the file, finds that the Report and Recommendation should be approved, confirmed and adopted by the Court, and that Respondent Scott M. Powers should be suspended from the practice of law for a period of nine months. It is, therefore,

ADJUDGED AND ORDERED that the Board of Professional Responsibility’s Report and Recommendation for Suspension, which is attached hereto and incorporated herein, shall be, and the same hereby is, approved, confirmed, and adopted by this Court; and it is further

ADJUDGED AND ORDERED that, as a result of the conduct set forth in the Report and Recommendation for Suspension, Respondent Scott M. Powers shall be, and hereby is, suspended from the practice of law for a period of nine months, beginning May 1, 2014; and it is further

ORDERED that Respondent shall comply with Section 22 of the Disciplinary Code for the Wyoming State Bar. That Section governs the duties of disbarred and suspended attorneys; and it is further

ORDERED that, pursuant to Section 26 of the Disciplinary Code for the Wyoming State Bar, Mr. Powers shall reimburse the Wyoming State Bar the amount of $50.00, representing the costs incurred in handling this matter, as well as pay the administrative fee of $500.00. Mr. Powers shall pay the total amount of $550.00 to the Clerk of the Board of Professional Responsibility on or before June 2, 2014; and it is further

ORDERED that the Clerk of this Court shall docket this Order Suspending Attorney from the Practice of Law, along with the incorporated Report and Recommendation for Suspension, as a matter coming regularly before this Court as a public record; and it is further

ORDERED that, pursuant to Section 4(a)(iv) of the Disciplinary Code for the Wyoming State Bar, this Order Suspending Attorney from the Practice of Law, along with the incorporated Report and Recommendation for Suspension, shall be published in the Wyoming Reporter and the Pacific Reporter; and it is further

ORDERED that the Clerk of this Court cause a copy of this Order Suspending Attorney from the Practice of Law to be served upon Respondent Scott M. Powers.

ORDER SUSPENDING ATTORNEY FROM PRACTICE OF LAW AND ASSESSING COSTS

[¶1] This matter comes before the Court upon a Report and Recommendation for 30 Day Suspension stipulated to by Petitioner, the Board of Professional Responsibility of the Wyoming State Bar (the Board); and Respondent, Stacy E. Casper. Although Respondent has stipulated to the violation and discipline, and the Court accepts the stipulated recommendation, the Court writes this opinion rather than simply adopting the Board’s recommendation because these are matters of considerable importance to members of the Wyoming State Bar.

[¶2] This is an attorney discipline case that arose out of Respondent’s billing excessive legal fees and her subsequent improper attempts to collect those fees.

[¶26] IT IS, THEREFORE, HEREBY ORDERED:

1. That the Report and Recommendation for 30 Day Suspension filed by the Board of Professional Responsibility of the Wyoming State Bar on January 10, 2014, is hereby, approved, confirmed, and adopted by this Court as modified above; and

2. That Stacy E. Casper be suspended from the practice of law for a period of thirty days, commencing August 1, 2014; and

3. That Stacy E. Casper reimburse her client’s ex-husband for the attorneys’ fees and costs he incurred as a result of Respondent’s improper filing of the Lien Statement; and

4. That Stacy E. Casper pay an administrative fee of $500 and costs of this disciplinary proceeding to the Wyoming State Bar on or before September 1, 2014; and

5. That, in conjunction with the Wyoming State Bar, Stacy E. Casper design and teach a Wyoming CLE program on proper billing practices and techniques; and

6. That the press release stipulated to by the parties shall be issued by the Wyoming State Bar.

Order Suspending Attorney from the Practice of Law

[¶1] This matter came before the Court upon a “Report and Recommendation for Suspension,” filed herein October 29, 2013, by the Board of Professional Responsibility for the Wyoming State Bar. After a careful review of the Board of Professional Responsibility’s Report and Recommendation for Suspension, Respondent’s “Appeal; Response to Report and Recommendation; Appeal and Request that the Court Calendar the Matter for Briefs and Argument Pursuant to Section 21(c)(iv) of the Disciplinary Code,” and the file, this Court first finds that Respondent’s appeal and request for briefing and argument should be denied. Pursuant to Section 21(c)(i), “[a] response shall state explicit reasons for the exceptions to the report together with a brief prepared in accordance with Rule 7.01, W.R.A.P.” The response filed herein does not comply with subsection (c)(i), so this Court finds that the appeal and request for briefing and argument should be denied.

[¶2] Second, this Court finds that the Report and Recommendation for Suspension should be approved, confirmed and adopted by the Court; and that the Respondent, William D. Bagley, should be suspended from the practice of law for a period of ninety (90) days. It is, therefore,

[¶3] ORDERED that Respondent’s Appeal and Request that the Court Calendar the Matter for Briefs and Argument Pursuant to Section 21(c)(iv) of the Disciplinary Code be, and hereby is, denied; and it is further

[¶4] ADJUDGED AND ORDERED that the Board of Professional Responsibility’s Report and Recommendation for Suspension, which is attached hereto and incorporated herein, shall be, and the same hereby is, approved, confirmed, and adopted by this Court; and it is further

[¶5] ADJUDGED AND ORDERED that, as a result of the conduct set forth in the Report and Recommendation for Suspension, Respondent William D. Bagley shall be, and hereby is, suspended from the practice of law for a period of ninety (90) days, beginning December 16, 2013; and it is further

[¶6] ORDERED that Respondent shall comply with Section 22 of the Disciplinary Code for the Wyoming State Bar. That Section governs the duties of disbarred and suspended attorneys; and it is further

[¶7] ORDERED that, pursuant to Section 26 of the Disciplinary Code for the Wyoming State Bar, William D. Bagley shall reimburse the Wyoming State Bar the amount of $5,831.92, representing the costs incurred in handling this matter, as well as pay an administrative fee of $500.00, by paying the total amount of $6,381.92 to the Clerk of the Board of Professional Responsibility on or before April 1, 2014; and it is further

[¶8] ORDERED that, pursuant to Section 4(a)(iv) of the Disciplinary Code for the Wyoming State Bar, this Order Suspending Attorney from the Practice of Law, along with the incorporated Report and Recommendation for Suspension, shall be published in the Wyoming Reporter and the Pacific Reporter; and it is further

[¶9] ORDERED that the Clerk of this Court shall docket this Order Suspending Attorney from the Practice of Law, along with the Report and Recommendation for Suspension, as a matter coming regularly before this Court as a public record; and it is further

Pursuant to Section 17 of the Disciplinary Code for the Wyoming State Bar, Bar Counsel for the Wyoming State Bar filed, on April 11, 2013, a “Petition for Interim Suspension of Attorney.” The Court, after a careful review of the petition, the “Affidavit of Bar Counsel in Support of Petition for Interim Suspension of Attorney,” and the file, concludes that the petition for interim suspension should be granted and that Respondent should be suspended from the practice of law pending resolution of the formal charge that has been, or will be, filed against him. See Section 17(c) (“Within fifteen (15) days of the entry of an order of interim suspension, Bar Counsel shall file a formal charge.”) It is, therefore,

ADJUDGED AND ORDERED that, effective May 10, 2013, the Respondent, Clay B. Jenkins, shall be, and hereby is, suspended from the practice of law, pending final resolution of the formal charge that has been, or will be, filed against him; and it is further

ORDERED that, during the period of interim suspension, Respondent shall comply with the requirements of the Disciplinary Code for the Wyoming State Bar, particularly the requirements found in Section 22 of that code; and it is further

ORDERED that, pursuant to Section 4(a)(iv) of the Disciplinary Code for the Wyoming State Bar, this Order of Interim Suspension shall be published in the Pacific Reporter; and it is further

ORDERED that the Clerk of this Court shall transmit a copy of this Order of Interim Suspension to the Respondent, Bar Counsel, members of the Board of Professional Responsibility, and the clerks of the appropriate courts of the State of Wyoming.

Pursuant to Section 17 of the Disciplinary Code for the Wyoming State Bar, Bar Counsel for the Wyoming State Bar filed, on August 20, 2012, a “Petition for Interim Suspension of Attorney.”  The following day, Bar Counsel filed an “Amended Petition for Interim Suspension of Attorney.”  The Court, after a careful review of the Petition for Interim Suspension, the amended petition, the “Affidavit of Bar Counsel in Support of Petition for Interim Suspension of Attorney,” and the file, concludes that the petition for interim suspension should be granted and that Respondent should be suspended from the practice of law pending resolution of the formal charge that has been, or will be, filed against her.  See Section 17(c) (“Within fifteen (15) days of the entry of an order of interim suspension, Bar Counsel shall file a formal charge.”)  It is, therefore,

Order Suspending Attorney From the Practice of Law

The matter came before the Court upon a “Report and Recommendation for Discipline” filed Nov. 26, 2008, by the Board of Professional Responsibility for the Wyoming State Bar. After a careful review of the Board’s report and the File, the Court finds that the Report and Recommendation should be approved, confirmed and adopted by the Court; and that Respondent should be suspended from the practice of law for a period of one year, beginning on January 2, 2009.

Cecil A. Cundy will comply with the requirements of the Disciplinary Code for the Wyoming State Bar, reimburse the Bar in the amount of $2649.37. The order shall be docketed as a public record and published in the Wyoming Reporter and the Pacific Reporter, served upon the Respondent and transmitted to the members of the Board of Professional Responsibility and the appropriate clerks of court.

Order Suspending Attorney From the Practice of Law

The matter came before the Court upon a “Findings of Fact, Conclusions of Law and Recommendation for Reinstatement” filed June 4, 2008, by the Board of Professional Responsibility for the Wyoming State Bar. The Court reviewed the Board’s report, the transcript of the Board’s hearing and the file. The Court accepted in part and rejected in part the Board’s recommendations.

The Board concluded that Elsom was eligible to be reinstated however the Court differed with the Board with respect as to how the period of suspension would be measured. The Court stated that Elsom was suspended from the practice of law for two years beginning September 25, 2007 and was required to pay $3,095.54 for the costs of the Board’s hearing. The Court noted that Elsom had a CLE suspension on which the Board of Continuing Legal Education had not yet recommended reinstatement and that he must resolve that suspension. The suspension shall be published in the Wyoming and Pacific Reporters and the information transmitted to the Board and the clerks of the appropriate courts in Wyoming.

The Court, after a careful review of the Board’s report and recommendation; the Colorado Supreme Court’s “Order Approving Conditional Admission of Misconduct and Imposing Sanctions Pursuant to C.R.C.P. 251.22; the “Stipulation”; the Affidavit of Costs and Expenses; the Motion for Reciprocal Discipline and to File a Report and Recommendation for Discipline; and the file, found that the Report and Recommendation for Reciprocal Discipline should be approved, confirmed and adopted by the Court.

Consistent with the discipline imposed by the Colorado Supreme Court, Respondent Judson shall be suspended from the practice of law in Wyoming for a period of one year and one day with six months already served. The remaining six months shall be stayed upon the successful completion of the three-year period of probation referenced in the Colorado Supreme Court Order. Respondent Judson shall reimburse the Wyoming State Bar $87.87 and a $500.00 administrative fee.
