Order Granting Petition for Writ of Review, Order Vacating Warrant of Execution, Order Setting Date of Execution, and Order Staying Execution
The Court ordered that Eaton be allowed to proceed in the matter in forma pauperis. The “Petition for Writ of Review, or in the Alternative, Petition for Writ of Certiorari” was granted. The “Warrant of Execution” entered by the district court was quashed and vacated. The new date for execution of the sentence of death is December 19, 2008. The sentence of death was stayed pending Petitioner’s timely application to the United States Supreme Court for a writ of certiorari. Petitioner’s counsel was ordered to notify the Court and the State of counsel’s timely filing and was required to file a status report. Petitioner’s counsel was ordered to notify the Court and the State when the United States Supreme Court had disposed of the petition for writ of certiorari. The Court retained jurisdiction and the case is to remain open.
