Order Affirming Judgment and Sentence of the District Court: The matter came before the Court upon the pro se “Appellant Brief of Jacob Paul Martinez” filed December 6, 2007. In September 2007, Appellant’s court-appointed appellate counsel was allowed to withdraw as counsel pursuant to Anders v. California. The Court entered its “Order Granting Permission for Court Appointed Counsel to Withdraw and Conditionally Affirming the Judgment and Sentence” in October 2007. After a review of Appellant’s brief, the Court found the appeal frivolous and therefore affirmed the “Sentence” in the matter.

Affirmed.
